Terms & Conditions

These Terms comply with the UK Consumer Rights Act 2015, Consumer Contracts Regulations 2013, and relevant trading standards guidance.
1. Scope
These Terms & Conditions govern all transactions carried out at Phone Max, Cheltenham (the “Shop”) and any interactions with our website. By using our services, buying or selling devices, or booking a repair, you agree to these Terms.
2. Products & Sales
- All products (new or used) are sold as described at the point of sale. Used devices and accessories may show signs of previous use; condition and pricing will reflect this. Customers are responsible for checking compatibility (e.g. network, accessories) before purchase.
3. New Phones – Sales Terms
- New phones include the manufacturer’s warranty (typically 12 months).
- Returns accepted within 14 days if the phone is sealed and unused.
- Once opened, returns are only accepted if the device is faulty.
- Physical or accidental damage is not covered.
4. Used Phones – Sales Terms
- All used phones are tested and sold in working condition, unless sold as “spares/repairs”.
- Used phones include a 30‑day warranty for hardware faults.
- Warranty excludes:
- Cracked screens
- Water damage
- Accidental damage
- Loss or theft
- Returns accepted within 14 days if the phone is in the same condition as sold.
- IMEI numbers are recorded for security and fraud prevention.
5. Accessories – Sales Terms
- All accessories are sold new, unless clearly marked as used.
- Returns accepted within 14 days if unused, in original packaging, and with proof of purchase.
- Faulty accessories can be refunded or exchanged within 30 days.
- Damage caused by misuse, drops, or water is not covered.
6. Selling or Trading Devices to Us
- Customers selling or trading a device must be the legal owner of the item. All devices must be free from iCloud, Google, or other account locks and not reported as lost or stolen. Once sold, ownership transfers to Phone Max and the agreed price is final.
7. Phone Repairs – Service Terms
- Repairs include a warranty on parts and workmanship:
- Screens: 3–12 months (depending on part grade)
- Batteries: 3 months
- Other repairs: 30–90 days
- All repairs come with 90 DAY warranty unless otherwise stated, providing the device or goods are returned in the original condition.
- Warranty covers defects only, not accidental damage or physical crack or damage
- Warranty is void if the device is opened or repaired elsewhere after our service.
- Devices with water damage or motherboard faults have no guarantee due to unpredictable behaviour.
- Customers are responsible for backing up data. We are not liable for data loss.
- Devices left uncollected for over 90 days may be recycled or disposed of.
8. Repairs & Services
- Customers must back up their data before submitting a device for repair. While we take care during service, we cannot be held responsible for data loss, settings changes, or personal files. Our responsibility is limited to the specific fault or component repaired/replaced. We are not liable for unrelated, pre-existing, or subsequent faults that may arise. Replacement parts may be original, OEM, or high-quality alternatives depending on availability (this will be clarified with the customer).
9. Pick-Up & Drop-Off Service
- Devices collected/delivered under this service remain the responsibility of the customer for any pre-existing faults or damage. Phone Max is only liable for the specific repair/service undertaken, not for any unrelated or new issues that may arise after delivery.
10. Deposits & Payments
- Deposits for repairs or special orders are non‑refundable.
- Full payment is required before collection.
- We accept cash, card, and bank transfer.
11. Returns & Refunds
- Returns are accepted only for faulty items after investigation by our technicians. If the issue is verified as pre-existing (not caused by the customer), a refund, replacement, or repair will be offered. We do not offer refunds or exchanges for unwanted items.
12. Data & Privacy
- We do not access personal data unless required for testing. Customers must remove passcodes where possible. We are not responsible for data loss during repair.
13. Liability
- Phone Max will not be responsible for:
- Cases, SIM cards, or accessories left on devices
- Damage caused by customer misuse
- Issues caused by previous third‑party repairs
- Data loss, settings, or personal files during repairs or testing.
- Any indirect, incidental, or consequential damages.
- Our maximum liability is limited to the value of the service or item purchased.
14. Complaints
- Complaints can be made in‑store or by email. We aim to resolve all issues within 7 working days.
15. Applicable Law
- These Terms & Conditions are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
